Terms of Service

These Terms of Service ("Terms") govern your access to and use of PreMartX (the "Service"), operated by the PreMartX team ("we", "us"). By creating an account or using the Service you agree to these Terms, our Privacy Policy, and the Official Contest Rules. If you do not agree, do not use the Service.
1. What the Service is
PreMartX operates skill-based prediction tournaments. Inside a tournament you trade simulated balances ("Arena Credits") against real-time mirrored prediction-market prices. Arena Credits have no monetary value. Tournament prizes, where offered, are real US dollars: a fixed schedule of amounts disclosed and funded into escrow before entries open, not a share of a variable pool of entry fees. The Service does not accept, place, route, or execute wagers or orders on any real-money market on your behalf.
2. Eligibility
- You must be at least 18 years old (or the age of majority in your jurisdiction, if higher).
- You may maintain only one account. Creating or controlling multiple accounts is prohibited.
- Paid tournaments are unavailable to residents of, and to persons physically located in, restricted jurisdictions — currently: Washington (WA), Idaho (ID), Montana (MT), Nevada (NV), Arizona (AZ), Louisiana (LA), Hawaii (HI). This list may change and is set out in the Contest Rules.
- Employees and contractors of PreMartX, and members of their households, may not enter paid tournaments.
- You may not use the Service if you are subject to US sanctions or appear on any US government prohibited-party list.
3. Accounts and security
You are responsible for your login credentials and all activity under your account. Notify us immediately of any unauthorized use. We may require identity verification (KYC) before you enter paid tournaments or withdraw funds, and we may suspend accounts pending verification or investigation.
4. Wallet, deposits, and withdrawals
- Deposits are between $10.00 and $1,000.00 per transaction. Accounts without verified identity are capped at $500.00 in lifetime deposits.
- Wallet funds may be used only to enter tournaments. We do not pay interest on balances.
- Withdrawals have a $20.00 minimum and are subject to human review before payment, including fraud, anti-money-laundering, and sanctions checks. Prize recipients with $600.00 or more in cumulative annual prizes must provide a completed IRS Form W-9 before payment and will receive a Form 1099.
- Chargebacks and payment disputes made in bad faith may result in account suspension and forfeiture of contest winnings.
5. Tournaments, credits, and prizes
- Arena Credits are simulated, non-transferable, non-redeemable, and reset with each tournament entry.
- Prizes for a paid tournament are a fixed, pre-announced schedule of amounts by finishing position, funded into escrow before entries open — not a percentage of a variable pool. The platform retains entry fees beyond the advertised prizes and funds any shortfall.
- Entry fees, the fixed prize schedule, and entrant limits are disclosed on each tournament lobby before entry.
- Final standing is determined by a concentration-adjusted equity score (each market's contribution to your gains is capped). Scoring, settlement, disqualification, refunds, and dispute procedures are governed by the Official Contest Rules.
- If a tournament is cancelled, entry fees are refunded in full to your wallet.
6. Bots and automated play
- You may build and run trading bots using the tools provided by the Service. Bots may only act through our official interfaces.
- You retain ownership of your bot configurations. You grant us a license to execute, store, and analyze them to operate the Service.
- Scraping, reverse engineering the fill engine, exploiting platform defects, or automating outside the sanctioned bot pipeline is prohibited.
7. Prohibited conduct
- Collusion between accounts, chip dumping, or coordinated trading intended to move prize distribution.
- Multi-accounting, account sharing, or entering the same tournament through accounts you control.
- Syndicates, staking rings, prize-sharing or profit-splitting arrangements, or partitioning mutually-exclusive outcomes across accounts to guarantee a placing.
- Exploiting bugs, feed errors, or platform defects instead of reporting them.
- Circumventing geographic restrictions, including via VPN or location spoofing.
- Any unlawful use, including money laundering or structuring.
8. Data and research
You should know: tournament entries, orders, bot configurations, and decision traces may inform proprietary research, including research into market behavior and trading strategies conducted by us or our affiliates. Public leaderboards display your chosen display name and results. Details are in the Privacy Policy.
9. Intellectual property
The Service, including its software, design, and content, is owned by us or our licensors. Market data is sourced from third-party venues and is provided for contest play only; you may not redistribute it.
10. Disclaimers
The Service is provided "as is" without warranties of any kind. We do not warrant uninterrupted operation, error-free price feeds, or the accuracy of any market data. Nothing on the Service is investment, financial, or legal advice. Simulated trading results do not predict real-market results.
Availability and interruption. The Service, and any individual contest, may be interrupted, suspended, or voided — for maintenance, market-data outages, integrity halts, or other issues. If a contest is voided, your sole remedy is a full refund of that contest's entry fee to your wallet, as set out in the Official Contest Rules.
11. Limitation of liability
To the maximum extent permitted by law, our aggregate liability to you for all claims arising out of the Service is limited to the greater of (a) the total entry fees you paid in the six months preceding the claim and (b) $100. We are not liable for indirect, incidental, or consequential damages.
12. Indemnification
You will indemnify us against claims arising from your breach of these Terms, your violation of law, or your infringement of third-party rights.
13. Suspension and termination
We may suspend or terminate accounts that violate these Terms or the Contest Rules. On lawful termination for violation, unpaid contest winnings tied to the violation may be forfeited; wallet balances from deposits are returned except where withheld under law or pending investigation.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules. Before filing any claim, you agree to contact us and attempt informal resolution for 30 days. Venue and any arbitration provisions will be finalized on counsel review of this draft.
15. Changes
We may update these Terms. Material changes will be announced in-product at least 14 days before they take effect; continued use after the effective date is acceptance.
